How long does a background check take?

Depending on the scope and nature of the background check, on average, turnaround time is 2 business days.

How far back do background checks go?

The information provided on a background check will vary depending on the integrity of the information and the applicable law. Generally, criminal checks are limited to 7 or 10 years. Other types of searches, such as education and employment verification are not bound by time constraints.

Why can’t Employee Relations conduct a background information without the applicant’s knowledge?

State and Federal laws require that an applicant be provided written notice and receive a written acknowledgment from an applicant authorizing the background report.

Is there a national criminal database that information is drawn from?

While there are national databases such as the National Crime Information Center (NCIC), these are only accessible to law enforcement agencies.  There are various ways of obtaining the necessary, legally permissible, information for background checks.

Is it illegal for to test for marijuana in a state that has decriminalized its possession and use?

There is a lot of confusion regarding employee drug testing for marijuana in states that have legalized it. However, marijuana is still a Class 1 illegal controlled substance according to the federal government. Along with that fact, if you have a company drug-free policy against the use of drugs at work, you are permitted to test for THC/marijuana.
