Criminal Search Reports
Employee Relations can help you ascertain the accuracy of information with the following types of record search reports:
The Criminal Report will report misdemeanor and felony convictions, infractions and charges with disposition pending for applicant's current geographic jurisdiction. Search can be conducted for Primary Name, Given Name or Alias Names. Additionally, selected or all geographic jurisdictions that applicant resided in or came into contact with can also be searched.
- Access to reports 24/7 via the internet
- Criminal, sexual, economic or violent offenders, more often than not fail to disclose their histories to potential employers
- National Databases Records are infrequently, if at all, updated to provide the most current information, making its use for employment purposes a violation of Federal Law (FCRA) (see below).
* National Databases - unfortunately, and contrary to popular belief, there is currently no one-stop comprehensive source for criminal background information that can be relied upon for accurate information in the employment environment. While there are many databases containing millions of criminal records, none contain enough identifying information to be certain the record belongs to a particular subject or simply someone else with the same or a similar name. Additionally, the database records are infrequently, if at all, updated to provide the most current information, making its use for employment purposes a violation of Federal Law (FCRA). The value pointed to by the purveyors of such databases is that it may point to areas that should be searched. Often, when common names are involved it may require the searching of hundreds of county court records, which will usually be cost prohibitive for most agencies. Therefore, we recommend utilizing the investigative intelligence already in place in the credit bureaus and subsequently available through a Social Security ID Trace, A Civil Records Check or a Credit report to determine which of the 3043 court jurisdictions in the U.S. to search for criminal activity. To date, this company has never been informed of a conviction that was not uncovered through this process, while at the same time, utilizing this system we have uncovered several dozen cases that were unreported through either State criminal record repositories or even the NCIC system operated by the FBI. While some job applicants will have had activity in several jurisdictions, the national average is 3, making searches of those jurisdictions economically feasible.
